Last Will and Testament of Adam Bender
In the name of God Amen. The thirteenth day of November in the year of Our Lord God 1744. I Adam Bender of Leacock in the County of Lancaster and Province of Penfilvania, yeoman, being very sick and weaek But of perfect mind and Memory Thancks be Given unto God therefore Calling unto mind the Mortality of my Body And knowing that it appointed for all men once to Dye Do maeke and Ordain this my Last Will and Testament That is to Say principaly and first of all I Give and Recommend my Soul into the hands of God that Gave it and for my Body I Recomend it to the Earth to be Buried in a Christian Lieke and Decent Manner at the Descretion of my Executors nothing Doubting but at the General Refsurection I Shal Receive the Same Again by the Mighty power of God And as touching Such Wordly Estate Wherewith it has pleased God to Blefs me in this Life I Give Devise and Dispose of the Same in the following Manner and from IMPRIMIS It is my Will and I Do Order that in the first place all my Just Debts and funeral Charges be paid and Satesfayed Item it is my will that the Land Shal be paid by the proprietors out of my Moveables or personal Estate And I Give and Bequeath unto Maria Feronica, my Beloved Wife, One third part of all my Real and Personal Estate And before it is Shared to three parts She Shal take Out of My Moveables a Bed and Coverings Thereto Belonging Item I Give all the Rest and Residue of my Real and personal Estate unto my five Children, Named John, Adam, David, Elizabeth and Maria and their Heirs forever It shal be Shared in five equal shares one shal have as much as the other. The Land shal have My oldest son John (or the Oldest then Alive). And it shal be aprised to him reasonably and he shal give unto the other heirs their shares out of it in reasonable terms and not in to high terms that he can maintain it and my wife shal live upon and use the plantation. (She Marrys or not if She will til my oldest son John cometh to his age, unlefs she should get a husband who would waste it and in case she should not Marry again when my Oldest son John comes to his age then she shal have the Liberty to live by my siad son in the House or if he would not suffer her to live in his house then he shal be obliged to build a house ofr her use during her life and it is my will that all my Reak abd personal Estate shal be Apprised by four impartial men --- And I nominate and appoint John Decvedarffer of Erltown, Yeoman and John Swope of Leacock potter to be the Executors of this my Last Will and Testament and I do hereby utterly difallow revoke and difanul all and every other former Testaments, Wills, Legacies and Executors by me in any ways before this time named Willed and Bequeathed Ratifying and Confirming this and no Other to be my Last Will and Testament in Witnefs whereof I have Hereunto Set my Hand and Sael the Day and year Above written.

LANCAST COUNTY March the 25th Ano Dom 1745. Then perfonally Appeared Wolfgang Newcomer and Andrew Moseman, Two of the Witnefses of the within Written Will and on their Solemn afirmation did declare They were present & Saw & heard Adam Bender the Testator above Named Sign & Seal the Above Will As his Last Will & Testament And that at the Doing thereof he was of Sounf & Disposing mind & understanding To the Best of their Knowledge.

BE IT REMEMBERED That on the 25th Day of March Ano Dom 1745. The Last Will & Testament of Adam Bender Deceased was proved in Due form of Law And Probate and Letters Testamentary were Granted unto John Devedarfar & John Swope Having first Affirmed Well & truly To Adminster the said Deceds Estate and Bring an Inventory Thereof Into the Registers Office in Lancaster County on or Before the 25th Day of April nest And Also to Render an Account when Thereunto Legaly Required Given under the Seal of the said Office.
